Privacy Policy

This document is a proposal from an Limited liability company “SOFTDEN“, acting on the basis of an entry in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Formations No. 1000721020000046893 dated August 31, 2021, hereinafter referred to as the "Owner", to conclude a Privacy Policy agreement on the conditions specified in this document with any person who has logged into the Site https://soft-den.com/ , hereinafter referred to as the "User".

This document has the legal status of an offer on the terms of an accession agreement.

Before using the Site, we ask you to carefully read this Privacy Policy document on non-disclosure and ensuring the protection of the confidentiality of Personal Data that the User provides to the Owner using the Site, and confirm your full agreement with the terms of this document. This confirmation occurs through further use of the Site, including the provision of your data in the relevant Site sections.

The User does not have the legal right to use the Site if they do not agree with the terms of this document or has not reached the legal age when they have the right to conclude contracts of this type.

Carrying out any actions within the Site and/or using any part of the Site, the User provides their unequivocal consent to the terms of this document and grants the Owner the right to process the User's Personal Data on the terms of this document. The User must leave this Site if they do not agree with the Privacy Policy.

1. Terms and Definitions

The following terms are used in this Privacy Policy:

• "Site" is an open and publicly accessible website owned by the Owner, located on the Internet at https://soft-den.com/ , together with all its pages, subdomains and software that provide information display.
• "Owner" is an Limited liability company “SOFTDEN“, acting on the basis of an entry in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Formations No. 1000721020000046893 dated August 31, 2021, who owns the rights and maintains the Site.
• "User" is a person who has access to the Site via the Internet and uses the services of the Site.
• "Personal Data" is information or a set of information about the User who is identified or can be accurately identified. The User may be asked to enter Personal Data on the Site in order to provide feedback.
• "Processing of Personal Data" is any action or a set of actions performed with the use of automation tools or without the use of such tools with Personal Data. Such as collecting, recording, systematising, structuring, storing, clarifying (updating, changing), improving, viewing, using, distributing or any other type of providing access to third parties, as well as depersonalisation, blocking, deletion of Personal Data.
• "Confidentiality of Personal Data" is a mandatory requirement for the Owner or another person who has gained access to Personal Data to prevent their dissemination without the consent of the User or in the absence of another legal basis.

2. Object of the Privacy Policy

This Privacy Policy establishes the Owner's obligations not to disclose and ensure the confidentiality of the Personal Data that the User provides to the Owner while using the Site.

The Personal Data that is permitted to be processed within the scope of this Privacy Policy include:

• Full Name;
• Email;
• Phone number.

The site system protects the User's data, which is transmitted automatically during the use of the Site:

• IP address;
• web browser information;
• access time;
• the address of the page;
• the address of the previous page.

The Site User does not have the right to distribute, modify, transfer, use or reuse any information from the Site for any public or commercial purpose without the written permission of the Owner. The copied information must contain an active hyperlink to the Site. Copying of information from the Site can be carried out for non-commercial purposes for posting on the user's personal pages, blogs, social networks, and so on.

The User acknowledges that in case of neglect of the security of Personal Data, third-parties may gain unauthorised access to the User's data. The Owner is not responsible for damages caused by such access.

3. Objectives of data collection

The Owner collects and has the right to use the User's Personal Data for the following purposes:

• providing the User with access to the personalised Site services;
• establishing feedback with the User, including sending messages, requests regarding the use of the Site's services, processing User requests;
• determining the location of the User in order to ensure security and prevent fraud;
• providing the User with effective customer and technical support in case of problems while using the Site;
• providing the User with special offers, information on prices, newsletters and other information on behalf of the Owner or on behalf of the Owner's partners with the User’s consent.

4. Methods and terms of data processing

The processing of the User's Personal Data is carried out without any time limit in any legal way, including in Personal Data information systems using automation tools or without using them.

The User's Personal Data can be transferred to authorized bodies only on the basis and in the manner established by the legislation of Ukraine. In case of loss or disclosure of Personal Data, the Owner informs the User about the loss or disclosure of Personal Data. The Owner, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User's Personal Data.

The technical staff developing and supporting the Site takes the necessary technical measures to protect the User's Personal Data from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, as well as from other illegal actions of third parties.

5. User Rights

Owners of Personal Data in accordance with the legislation of Ukraine have the following rights:

• Be aware of the sources of collection, the location of their Personal Data, the purposes of their processing, the location or place of residence of the owner or manager of Personal Data. Or instruct authorized representatives to obtain this information, except as otherwise established by law;
• Receive information about the conditions for providing access to Personal Data. Including information about third parties to whom Personal Data is provided;
• Access to their Personal Data;
• Receive an answer on whether Personal Data is processed or stored, as well as receive the content of Personal Data no later than thirty calendar days from the day the request was sent, except as otherwise established by law;
• Submit a reasoned request to the Owner with an objection to the processing of their Personal Data;
• Submit a reasoned request to change or destroy their Personal Data by the Owner or processor of Personal Data if these data are processed illegally or are inaccurate;
• Receive protection of their Personal Data from illegal processing and accidental loss, destruction, damage due to deliberate concealment, failure to provide or untimely provision of them, as well as to protection from the provision of information that is inaccurate or defaming the honor, dignity and business reputation of a person;
• Apply with complaints about the processing of their Personal Data to the Human Rights Ombudsman of the Verkhovna Rada of Ukraine or to the court;
• Apply remedies in case of violation of the legislation on the protection of Personal Data;
• Make clauses about limiting the right to process their Personal Data when giving consent;
• Withdraw consent to the processing of Personal Data;
• Be aware of the details of the automatic processing of Personal Data;
• Get protection from an automated solution that could have legal consequences.

6. Owner Responsibilities

The owner is obliged to:

• Use the received information solely for the purposes specified in clause 3 of this Privacy Policy;
• Ensure that confidential information is kept secret, not disclosed without the prior written consent of the User. And also not to exchange, publish or disclose in other possible ways the User Personal Data;
• Take precautions to protect the confidentiality of the User's Personal Data, which should be used to protect this kind of information in the current business course;
• Block the User's Personal Data, at the request of the User or their legal representative or an authorized organisation for the protection of Personal Data.

7. Privacy Policy changes

The User, using the Site, accepts the terms of this document, takes into account and agrees that this Privacy Policy may be changed. Changes to the Privacy Policy are published on this page of the Site. In some cases, the Owner reserves the right to publish privacy notes for certain programs.

8. Additional terms

The Owner is not responsible for damage or losses incurred by the User or third-parties as a result of a misunderstanding of the terms of this document and instructions for using the Site, regarding the procedure for posting data and other technical issues.

In the event that any provision of this document, including any proposal, clause or part thereof, is found to be contrary to the law or invalid, this will not affect other provisions that do not contradict the law. They retain their full legal force, and any invalid provision, or a provision that cannot be fulfilled without further action by the Parties, is considered amended, corrected to the extent necessary to ensure its validity and the possibility of implementation.

The Privacy Policy applies to the User from the moment they starts using the Site and is valid as long as any information about the User, including Personal Data, is stored on the Site.

The terms and geography of this document, including the storage period of the User's Personal Data, are not limited.
